1. Acceptance of Terms

By accessing or using the PhantomTech website (phantomtech.net), PhantomCTI, PhantomScan, or any of our related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.

2. Description of Services

PhantomTech provides enterprise cybersecurity solutions including:

  • PhantomCTI: A threat intelligence platform for aggregating, correlating, and enriching global threat data.
  • PhantomScan: An AI-powered vulnerability management platform with continuous scanning and risk prioritization.
  • Security Services: Penetration testing, red team operations, compliance assessments, and other expert-led security services.

3. Account Registration

Certain features of our Services require account registration. You agree to provide accurate, current, and complete information, and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Acceptable Use

You agree not to:

  • Use our Services for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to any part of our systems or infrastructure.
  • Interfere with or disrupt the integrity or performance of our Services.
  • Reverse engineer, decompile, or disassemble any part of our platforms.
  • Use our threat intelligence data to target, attack, or harm any third party.
  • Share, resell, or redistribute our data or reports without written authorization.
  • Use automated tools to scrape, crawl, or extract data from our Services beyond permitted API usage.

5. Intellectual Property

All content, features, functionality, software, and intellectual property related to our Services are owned by PhantomTech and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for their intended purpose.

6. Service Level and Availability

We strive to maintain high availability of our platforms. However, we do not guarantee uninterrupted or error-free operation. Scheduled maintenance windows will be communicated in advance where possible. Specific SLA commitments are defined in individual customer agreements.

7. Payment and Billing

Paid services are billed according to the pricing plan selected at the time of purchase. All fees are non-refundable unless otherwise stated. We reserve the right to modify pricing with 30 days' advance notice. Failure to pay may result in suspension or termination of access.

8. Data and Privacy

Your use of our Services is also governed by our Privacy Policy. You acknowledge that threat intelligence and vulnerability data processed through our platforms may contain sensitive information, and you agree to handle such data responsibly and in accordance with applicable data protection regulations.

9. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information disclosed during the use of our Services. This obligation survives termination of these Terms.

10. Limitation of Liability

To the maximum extent permitted by law, PhantomTech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use our Services. Our total liability shall not exceed the amount paid by you for the Services in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that threat intelligence data is exhaustive or that vulnerability scanning will detect all security issues. Our Services supplement but do not replace professional security judgment.

12. Indemnification

You agree to indemnify and hold harmless PhantomTech, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our Services or violation of these Terms.

13. Termination

We may suspend or terminate your access to our Services at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will remain in effect.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via our website or email. Continued use of our Services after changes constitutes acceptance of the updated Terms.
